TRANSMISSION OF SECURITIES:- ‘Transmission of Securities’ refers to the process of transferring the ownership of certain securities from the current owner to another person (legal heirs, nominee, joint holder, etc.) in case of death or lunacy of the current owner, or through inheritance or insolvency.
As per SEBI Circular dated May 18, 2022 reviewing the process that the Registrars to an Issue and Share Transfer Agents (“RTAs”) and Depositories/Issuing companies follow for transmission of securities, a simpler process has been proposed by SEBI so that people can easily deal in the securities markets, as well as make the securities’ transmission process more efficient, faster and easier to use.
According to the Securities and Exchange Board of India (with a list of Obligations and Disclosure Requirements) (Fourth Amendment) Regulations, 2022 (“LODR Amendment Regulations”), the process of transferring securities has been simplified. SEBI/LAD-NRO/GN/2022/80 dated April 25th, 2022) is given here.
